Heard on the Web: Budget Plan Revives President’s Call for New Charitable-Deduction Limit

According to a February 1 article in The Chronicle on Philanthropy, Suzanne Perry reports that President Obama's budget proposals for fiscal 2011 "would limit to 28 percent the tax break couples earning $250,000 (or individuals earning $200,000) could get for their itemized deductions, including gifts to charity." A similar proposal failed Congressional endorsement last year.

New Charitable-Deduction Limit

This proposal seemingly does not empower or encourage those vital mediating structures of our society. Those local mediating structures -- schools, civic organizations, churches, businesses, etc -- can do a better job in solving problems and meeting human needs than government.

how many Americans even give 28%?

This article would provide more information if it would include the number of Americans who give over 28%, or those who make over $250,000 who give over 28%. Without knowing these numbers, we really have no way to know if non-profits should panic or not. Sure, this will effect some people -- but I believe the numbers are very, very small, since overall, Americans give 2.2% away.

It's not about the number of Americans who "give 28%" - it's the number of Americans with marginal tax rates in the highest tax brackets (currently 33% and 35%, but under the proposed budget would increase to 36% and 39.6%, respectively). For these upper brackets, the charitable deduction (and mortgage interest) would be limited as if the taxpayer were in the 28% marginal bracket. The question facing the charitable community is whether this limiting of the deduction for the top earners - who also are the major gift and planned gift donors who make the largest gifts to our organizations - will affect giving.
