Heard on the Web: Charitable Life Insurance Gift Program Blows Up on University, Donors

According to a report in the Des Moines Sunday Register and as further reported in TaxProf Blog, nearly 1,700 contributors to a University of Northern Iowa athletic scholarship fund lost an estimated $6.8 million in accumulated insurance this year when school officials determined the benefit violated federal tax law. The charitable split-dollar arrangements should have been terminated 10 years ago when Congress eliminated the favorable benefits associated with such arrangements and imposed severe tax penalties on their continued use.  MORE »

Lower Court Decision Affirmed: Failure to Obtain Life Insurance to Replace CRT Gift Not Malpractice

The Michigan Appeals Court has affirmed the decision of a lower court in Smallegan v. Kooistra in which it held that a donor's attorney did not commit malpractice because he did not ensure the donor had acquired wealth replacement life insurance prior to the funding of a charitable remainder trust.  MORE »

Managing Donated Life Insurance Policies

Many organizations fail to monitor their policies and may suffer unexpected losses of policy value that could have been easily prevented. With active management, charities can avoid these losses and help ensure that the donor?s charitable aims are achieved. This presentation shows charitable organizations how to periodically review and manage a portfolio of donated life insurance policies. A suggested review checklist, methods for obtaining current information, guidance on policy decision-making, and a discussion of management options for dealing with problem policies will be discussed.
